Legal assistance and appointments
Within civil and employment law, I focus primarily on social security and social assistance in disputes with INPS and INAIL: pensions and allowances under the Italian invalidità civile system, the ordinary invalidity allowance, allowances for personal assistance and for attendance at school or rehabilitation centres, exemptions from healthcare charges, the Disability Card, targeted employment placement for people with disabilities, blindness, deafness, recognition of disability status, workplace injuries and occupational diseases. The dispute concerned an INPS demand for repayment of two monthly instalments of a civil disability pension, for October and November 2025. Recovery followed a reassessment on 3 October 2025, which found a degree of disability insufficient to retain the pension. The report was communicated on 20 October.
INPS sought €4,071.73 in respect of a civil disability benefit paid between January 2022 and December 2023, alleging that the income limits had been exceeded. The claimant challenged recovery, pointing out that the start of employment had been reported and the income declared for tax purposes.
The case concerned €604.04 for January and February 2022, claimed back following an adverse medical reassessment. Among other arguments, the claimant maintained that notification had arrived after the January instalment had already been collected.
The dispute concerned the Italian social allowance paid from 1 January 2017 to 30 November 2019. INPS calculated an original overpayment of €11,930.71 because the income limits had been exceeded. Its outstanding demand against the heir was €9,909.52, as €2,021.19 had already been recovered.
INPS demanded €687.32, corresponding to the September and October 2024 instalments of the Italian allowance for attendance at educational or rehabilitation facilities. The reassessment report was communicated on 26 September, after the September instalment had been paid. The court claim concerned only that instalment, amounting to €343.66.
Following a reassessment on 20 May, INPS demanded €1,470.10 for June and July 2024. The claim sought a declaration that only the June instalment of €735.05, paid on the first day of the month, was irrecoverable.
