Incapacity pension: cessation of work affects the payment start date, not recognition of entitlement

Entitlement to the Italian ordinary incapacity pension and the date from which it becomes payable are separate matters. Once the medical and contribution conditions are established, continued employment does not, by itself, justify dismissal of the claim. The Tribunal of Foggia applied this principle in judgment No. 2035 of 26 June 2024 concerning Article 2 of Law No. 222/1984.

An earlier judgment had established medical eligibility from March 2023. INPS nevertheless withheld payment because that decision referred to an ordinary invalidity pension rather than an ordinary incapacity pension, and because the applicant remained registered on the lists of self-employed workers, without evidence of cessation of work.

Having considered the documents and INPS’s submissions, the Tribunal found the medical assessment for the ordinary incapacity pension undisputed and the benefit sought unambiguous. The contribution condition had not been specifically challenged either.

On employment, the judge referred to Court of Cassation judgment No. 15806/2001 and order No. 20829/2019. Under that case law, the conditions in Article 2(2) and (5) of Law No. 222/1984—including absence of earnings, removal from the prescribed registers and professional rolls, and waiver of earnings-replacement or supplementary payments—affect when the benefit becomes payable, rather than constituting additional conditions for entitlement itself.

The Tribunal upheld the claim and ordered INPS to pay the pension with the statutory ancillary amounts, making commencement conditional on satisfaction of the required conditions. It did not order automatic payment from March 2023: that date concerned medical eligibility. The distinction is between recognition of the right and the point at which payment may begin; absence of the latter conditions does not require dismissal of the claim.
